Hereinafter we inform about the collection of personal data when using our website. Personal data means all data relating to you, e. g. name, address, e-mailaddresses, user behaviour.

Controller
means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or. the specific criteria for its nomination may be provided for by Union or Member State  law.

Third party
means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

4. Collection of personal data as well as nature and purpose of its use.

a) Collection of personal data when visiting our website
Already when visiting our website for purely informative purposes, when you do not register or otherwise provide information to us, we collect the personal data your browser is providing to our server. This information is temporarily stored in a so-called logfile.

aa) Collection and storage of data required for technical reasons
If you want to view our website, we collect the following data which is technically necessary for us to display our website and to ensure the stability and safety:

  • IP address of the requesting computer / terminal
  • date and time of the request
  • content of the request (specific page)
  • browser
  • operating system and its interface

bb) Purposes
We process these data for the following purposes:

  • ensuring a smooth connection setup of the website
  • ensuring a comfortable use of our website

dd) Storage period
The logfiles are stored for a period of 190 days and will be deleted after expiration.

aa) What are cookies?
In addition to the previously mentioned data, cookies will be stored on your computer when using our website. Cookies are small text files which are automatically generated by your browser and which are stored on your terminal (laptop, tablet, smartphone or the like) when you visit our website. Cookies do no damage to your terminal, they do not contain viruses, Trojans or other malware. Information is stored in the cookie, each resulting in connection with the terminal specificly used. However this does not mean that we become  aware of your identity immediately.

Transient cookies are automatically deleted once you close the browser. These particularly include the session cookies. Most internet browsers automatically accept cookies. However you can configure your browser in such a way that no cookies are stored on your computer or that there will always be an information before a new cookie is stored. However the complete deactivation of cookies can result in not being able to use all functions of our website.

c) Use of the online contact form
aa) Collection of personal data
If you contact us via the online contact form, we will collect the data you have provided. In order to be able to help you quickly and effectively, we offer an upload function in addition to the usual information. This function allows you to send us a photo, e. g. of a proof of purchase. We will delete the data collected via the contact form after the storage is no longer required or we will restrict the processing in case of legal retention periods.
Mandatory we collect the following personal data:

Voluntary we collect the following personal data:

  • last name, first name
  • phone number (landline and/or mobile phone number)
  • address (street, postcode, city)
  • date of purchase
  • production number
  • type of appliance
  • if applicable other personal data resulting from the photos transmitted.

bb) Purpose
We collect the mandatory information in order to be able to answer to your request via the contact form quickly and straightforwardly.
We collect the voluntary data

  • in order to be able to address you personally for purposes of after-sales service,
  • in order to help you quickly and straightforwardly in case of a defective product within the scope of guarantee or warranty and
  • in order to provide you with answers to all your questions about one of our products.

cc) Legal basis
The collection of your e-mail address as well as of the information from your message takes place on basis of Art. 6 par. 1 s.1 lit. f GDPR. The legitimate interest is justified in the above mentioned purpose.
The collection of your name is based on Art. 6 par. 1 s.1 lit. a GDPR.
Legal basis for the collection of the telephone number, the address, the date of purchase, the production number as well as the type of appliance is Art. 6 par. 1 s. 1 lit. b GDPR.

d) Establishing contact by e-mail
aa) Collection of personal data
When getting in contact with us by e-mail, your e-mail address and the information from your request are collected and stored by us. We will delete these data after the storage is no longer required or we will restrict the processing in case of legal retention periods.

bb) Purpose
The e-mail address as well as other information from your request are collected in order to be able to answer your e-mail request.

cc) Legal basis
The processing of the e-mail address takes place on the basis of Art. 6 par. 1 s. 1 lit. f GDPR. The legitimate interest is given because the collection of your e-mail address is technically necessary for the receipt of the e-mail content and the subsequent reply to your e-mail request. The legal basis for the processing of further information from the request is Art. 6, par. 1 s. 1. lit. b GDPR.

e) Contact via WhatsApp
We offer you the option of sending (service) inquiries via WhatsApp on several of our platforms. It is only the customer who initiates the request, under no circumstances will the company itself proactively conduct so-called advertising approaches. The company is using a WhatsApp business account and thus is clearly identified as a company. WhatsApp is an instant messaging service provided by WhatsApp Inc./ WhatsApp Ireland Limited.

aa) Collection of personal data
When you contact us by WhatsApp, your phone number and the information from your request are collected and stored by us. We will delete the data collected via WhatsApp after the storage is no longer required or we will restrict the processing in case of legal retention periods.

bb) Purpose
The phone number is necessary to use / communicate with WhatsApp. All other information from your request is collected in order to be able to answer your WhatsApp-request. This can also be further data provided by you in the course of the conversation.

cc) Legal basis
(1) Specific business-related contact
If you get in specific business-related contact with us via WhatsApp, the legal basis for data processing is Art. 6, par. 1 p. 1 lit. b of GDPR (General Data Protection Regulation).
(2) General inquiries not related to a specific business
If you send us general, non-specific business inquires via WhatsApp, the legal basis for data processing is Art. 6, par. 1 p. 1 lit. f. of GDPR. The additional requirement of outweighing of the company’s interest over the interest of the person concerned regarding the integrity of his data will regularly be met already because the person concerned is initiating the contact with the company by sending his inquiry via WhatsApp and thus implicitly initiating the processing of his data in order to allow the company to answer his inquiry. Service and customer satisfaction is the mutual request.

5. Integration of YouTube videos

On our website we have integrated YouTube videos which are stored on htp://www.YouTube.com and are directly playable from our website. These are all integrated in the “extended data protection mode" which means that no data about you as user is transferred to Youtube if you do not play the videos. Only when you play the videos. the data referred to in a) will be transferred. We do not have any influence on this data transfer.

a) Collection of personal data by YouTube
If you visit the website, YouTube receives the information that you have accessed the corresponding subpage on our website. In addition, the data mentioned under 4. b) (use of cookies) of this declaration will be transferred. This takes place regardless of whether YouTube provides a user account to which you are logged in or whether there is no user account. If you are logged in to Google, your data will directly be allocated to your account. If you do not want your profile to be allocated to YouTube, you have to log out before actuating the button. We use the offer of Google Maps on this website. This allows us to show you interactive maps directly on the website and enables you to conveniently use the map function.

7. Use of Google webfonts

For the uniform display of fonts we use so-called webfonts which are provided by Google.

a) Data collection by Google
If you visit our website, your browser will download the necessary webfonts into your browser cache in order to display texts and fonts properly. For this purpose your browser must establish a connection to the servers of Google. By doing so, Google obtains knowledge that our website has been acessed via your IP address. If your browser does not support webfonts, a standard font of your computer will be used.

The use of Google webfonts is conducted in the interest of a uniform and attractive presentation of our online offers.

8. Use of a Facebook plug-in

We are currently using a Facebook page plug-in.

a) Collection of personal data by Facebook
For this purpose we use the so-called two-click solution. That means that if you visit our website, initially no personal data will be transferred to Facebook. We offer you the possibility to directly communicate with Facebook via the button. Only if you click on the marked field and thereby activate it, Facebook receives the information that you have accessed the corresponding website of our online offer. Additionally the data mentioned under Par. 4. b) (use of cookies) of this statement will be transferred. According to information by Facebook , in Germany the IP address is immediately pseudonymised after collection. Neither do we have influence on the data collected and data processing processes, nor are we aware of the full scope of data collection, the purposes of processing and the storage periods. Also we do not have information on the deletion of the data collected by Facebook.
 
b) Data transfer to the USA
By activating the plug-in personal data of you is transferred to Facebook and stored in the USA. Since Facebook mainly collects data via cookies, we recommend you to delete all cookies using your browser's security settings before clicking on the grayed-out box. The data transfer takes place no matter whether or not you have an account with Facebook and are logged in there. If you are logged in to Facebook, the data collected with us will be directly allocated to your existing account with Facebook. If you actuate the activated button and e. g. link the page, Facebook also stores this information in your user account and communicates this publicly to your contacts. We recommend you to log out regularly after using a social network, especially however before activating the button, as this way you can avoid an allocation to your Facebook profile.

c) Purposes
Facebook stores the data collected on you as usage profiles and uses them for the purpose of advertising, market research and/or demand-oriented design of its website. Such analysis (also for users who are not logged in) is made especially to display demand-oriented advertising and to inform other users of the social network about your activities on our website. You have the right to object against the setup of these user profiles. To exercise this right you must contact Facebook. With the Facebook plug-in we offer you the possibility to interact with the social networks and other users so that we can improve our offer and make it more interesting for you as a user.

9. Newsletter

a) Collection of personal data
aa) Collection of e-mail address and name
With your consent you can subscribe to our newsletter, informing you of our current interesting offers. The advertised goods and services are named in the declaration of consent. Mandatory for sending the newsletter is your e-mail address only. You can indicate your name voluntarily, if you want us to address you personally.

bb) Collection of further data in the framwork  of the “double-opt-in” procedure
For the registration to our newsletter, we use the so-called “double-opt-in” procedure. This means that once you have registered, we will send you an e-mail to the indicated e-mail address. In this e-mail we ask you to confirm that you wish to receive the newsletter. Furthermore we store your relevant IP addresses and times of registration and confirmation in each case.

b) Purposes
The collection of the e-mail address serves to send the newsletter. The purpose of the “Double-opt-in” procedure is to prove your registration and, if necessary, to be able to clarify possible misuse of your personal data. The collection of your name serves for the personal approach.

c) Legal basis
Legal basis is Art. 6 par. 1 s. 1 lit. a GDPR.

d) Right to withdraw
You can withdraw your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the withdrawal by clicking on the link provided in each newsletter e-mail or by e-mail to: newsletter@rommelsbacher.de or by sending a message to the contact details mentioned  in the imprint.

e) Period of storage
If you do not confirm your registration within 48 hours, your personal data will be initially stored, but it will not be used to send the newsletter (restriction). After another 120 hours at the latest, the collected personal data will be erased manually by an employee.

f) Analysis of the user behavior (so-called tracking)
We point out that we will analyse your user behaviour when sending the newsletter. For this analysis, the e-mails sent include so-called web beacons respectively tracking pixels showing one-pixes image files which are stored on our website. For the analyses we link the data mentioned in 4 b) (use of cookies) and web beacons with your e-mail address and an individual ID. Also links received in the newsletter contain this ID. With the data obtained like this, we setup a user profile to customize the newsletter according to your individual interests. In doing so we record when you read our newsletters, which links you click in the newsletters and from these results we conclude your personal interests. We link this data with actions you have taken on our website.
You can object to this tracking at any time by clicking on the separate link provided in each newsletter or by contacting us via another communication channel. This information will be stored as long as you subscribe to the newsletter. Once you have unsubscribed we will store the data only statistically and anonymously. Such tracking is also not possible, if you have deactivated the image viewing in your e-mail programme by default  In this case the newsletter will not be displayed completely and you may not be able to use all the features. If you have the images displayed manually, the above mentioned tracking takes place.

 

10. Using our webshop as guest

a) Collection of personal data
If you want to place an order in our webshop as a guest, that means without registration, it is necessary for the conclusion of the contract that you provide your personal data which we need for the processing of your oder.
aa) Mandatory information
Mandatory information required for the processing of the contracts are:

  • first name
  • last name
  • e-mail address
  • address (street, zip code, city, country)

bb) Optional information
Optional information is:

  • salutation
  • phone number

b) Purpose
We process the data provided by you to process your order resp. to contact you to clarify any queries about your order.

c) Legal basis
The legal basis for the data processing is Art. 6, par. 1 s. 1 lit. b  GDPR. Legal basis for the optional data is Art. 6 par. 1 s. 1 lit. a GDPR.

d) Period of storage
For reason of commercial and tax regulations, we are obliged to store your address, payment and order data for a period of ten years. However, after two years we are restricting processing, that means your data will only be used to comply with legal obligations.

e) Encryption of the order process
In order to prevent unauthorized access to your personal data by third parties, in particular to financial data, the order process is encrypted using TLS technology.

 

11. Use of a customer account with us

You can voluntarily create a customer account on our website. With this account you can save your favorite items in a wishlist. If you ceate an account under “my account”, the data you provide will be stored revocably. You can delete all further data including your user account, in the customer portal at any time.

a) Registration of  a customer account
aa) Collection of personal data
As far as you want to use a customer account with us, we collect the following obligatory data from you:

  • e-mail address
  • first name and last name as well as
  • a self-selected password.

bb) Use of the so-called „Double-Opt-In“ - procedure
For the registration we use the so-called double-opt-in procedure, that means your registration is only completed if you have previously confirmed your registration via a confirmation mail sent to you for this purpose by clicking on the link contained therein. If your confirmation is not received within 24 hours, your registration will be automatically deleted from our database.

cc) Purposes
The collection of the e-mail address is technically necessary for the performance of the double-opt-in procedure. The self-selected password for the customer account is used to protect your account. The force for real names serves for identity verification, payment administration and fraud prevention.

dd) Legal basis
Legal basis is Art. 6 par. 1 s. 1 lit. f GDPR. The legitimate interest is justified in the above mentioned purposes..

ee) Period of storage
If you use your customer account with us, we store the above mentioned mandatory information until you finally delete your access. Furthermore we store the voluntary data you have provided for the time of use of your customer account with us, unless you delete them before. You can manage and change all information in the protected customer portal.

ff) Encryption of the connection
In order to prevent unauthorized access to your personal data by third parties, in particular financial data, the connection is encrypted using TLS technology.

b) Storage of goods / acrticles in the wishlist (memory pad)
You can store certain articles and products of our product range in a wishlist respectively in a memory pad.
aa) Collection of personal data
Within the storage in the memory pad, we only collect the name of the stored product or article in combination with your customer account. We do not use this data for tracking or profiling. The collection is for statistical purposes only. For this reason the collected data also is pseudonymized.

bb) Purpose
The collection is for statistical purposes.

cc) Legal basis
The legal basis is Art. 6, par. 1 S, lit. f GDPR, where the legitimate interest is for the purpose mentioned above.

c) Ordering process with customer account
aa) Collection of further personal data
Mandatory for the processing of the contracts is - in addition to the personal data already collected according to No. 11 a) aa) - your address (street, postcode, city, country). Voluntary you can indicate your salutation, phone number and your date of birth

bb) Purposes
We process the data provided by you to process your order or to contact you to clarify any queries about your order.

cc) Legal basis
The legal basis for the mandatory data is Art. 6 par. 1 s.1 lit. f.b GDPR. The legal basis for the optional data is Art. 6 par. 1 s. 1 lit. a GDPR.

dd) Storage period

12. Use of Google AdSense

This website uses the online advertising service Goodle AdSense allowing to present you customized advertising. We are interested in showing you advertisement that may be of interest to you in order to make our website more interesting for you. For this purpose statistical information about you is collected, which are processed by our advertising partners. These advertisements are regognisable by the note “Google-advertisment” in the relevant advertising.

a) Collection of personal data
If you visit our website, Google receives the information that you have accessed our website. To do so, Google uses a web beacon in order to set a cookie on your computer. The data mentioned under § 4. b) (use of cookies) of this declaration will be transferred. Neither do we have influence on the data collected, nor are we aware of the full scope of data collection and the storage period. Your data is transmitted to the USA and is evaluated there. If you are logged in with your Google account, your data can be directly allocated to it. If you do not want this allocation to your Google profile, you have to log out. It is possible that this data is transferred to contractual partners of Google, to third parties and government agencies. The legal basis for the processing of your data is Art. 6, par. 1, s. 1 lit. a GDPR.
This website does not place any advertisments of third-party providers via Google AdSense.

b) Possibility of refusal of cookies
You can prevent the installation of Google AdSense cookies in different ways:

  • by setting your browser software accordingly, in particular the suppression of third party cookies will prevent that you receive any third party advertisments;
  • by deactivating the interest-related advertisment with Google by using the link http://www.google.de/ads/preferences, whereby this setting will be deleted when you delete your cookies;
  • by deactivating the interest-related advertisment of providers being part of the self-regulatory campaign “About Ads” by using the link http://www.aboutads.info/choices, whereby this setting will be deleted when you delete your cookies;

13. Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google LLC (“Google”).

a) Collection and transfer of personal data to a third country
Google Analytics uses so-called “cookies” (see 4. b), text files which are stored on your computer and allow an analysis of the use of the website by you. The information about your use of this website generated by the cookie usually is transmitted to a Google server in the USA and is stored there. If IP anonymization is activated on this website, however Google will initially truncate your IP-address within  member states of the European Union or other contracting parties of the agreement on the European Economic Area. Only in exceptional cases the full IP-address will be transferred to a Google server in the USA and truncated there.
